Conduct: On 09 June 2020, Mr Mohammad Nawaz (“Mr Nawaz), caused River Cottage Scotland Limited (“RCS”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overestimating its turnover on the BBL application. As a result, RCS received more funds than it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019; or where a business was established after 01 January 2019, applicants were to provide their estimated annual turnover from the date it commenced to trade. • RCS was incorporated on 25 November 2019 and was therefore required to provide its annual estimated turnover from the date it commenced to trade. • On 09 June 2020, Mr Nawaz applied for a BBL of £50,000 on behalf of RCS declaring that its estimated turnover was £220,000. RCS received the BBL funds of £50,000 on 15 June 2020. • Filed accounts for the period ending 30 November 2020 show a turnover of £18,045. • RCS’s bank account was opened on 03 April 2020 with the first transaction being the receipt of £490 cash on 23 April 2020. Mr Nawaz has not provided any documentary evidence to show the cash trading income RCS received when the company started trading from 30 November 2019. • RCS’s bank statements show sales related credits from 23 April 2020. From this date, to 30 November 2020, the company received £12,027 annual turnover. Using the turnover declared in the prepared accounts for the year ended 30/11/20 of £18,045, RCS would have been entitled to apply for a BBL of £4,511. Therefore, RCS has received BBL funds of £45,489 to which it was not entitled. • Mr Nawaz has not provided any documentary evidence to support the estimated turnover figure of £220,000 and therefore RCS’ eligibility to apply for a BBL of £50,000. • On 30 April 2024, RCS entered Creditor’s Voluntary Liquidation with total liabilities listed of £40,130, £37,000 of which was listed as being owed in respect of the BBL.
