Conduct: Mr Muhammad Anas “(Mr Anas”) caused or allowed TAA Clerical Services Limited (“TCSL”) to apply for a Bounce Back Loan (BBL) of £50,000 using an overstated estimated turnover figure in the application form, resulting in TCSL receiving a BBL of £50,000, which more than it was entitled to. Furthermore, the BBL was not used for the economic benefit of TCSL, in breach of the BBL terms and conditions, in that • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. The bounce back loan funds should only be used for the economic benefit of the business. • TCSL was incorporated on 21 August 2019. • Mr Anas was sole director of TCSL from 31 May 2020. • On 5 June 2020 an application on behalf of TCSL was made declaring the estimated turnover of £228,000. • On 8 June 2020 TCSL received BBL funds of £50,000. • TCSL bank records show income between December 2019 and December 2020 to be £33,765 which would allow for a BBL of £6,753 based on a full 12 month trading period. • On 16 June 2020 £50,000 was transferred to an unknown company. Between the BBL payments and the date of transfer no business income was received. • No evidence has been supplied that these payments were for the economic benefit of the company. • The Sole creditor at liquidation is the BBL lender with a claim for £50,000.
