Conduct: Amal Sultani (Mr Sultani) caused Sultani Stirling Limited (Stirling) to apply for a Bounce Back Loan (BBL) of £45,000 on 10 June 2020 using overstated turnover figures in the BBL application form. Consequently, Stirling received more monies than it was entitled to from the BBL scheme, in that: • Businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019. • Stirling was incorporated on 05 August 2019. • On 10 June 2020 Mr Sultani applied for a BBL of £45,000 on behalf of Stirling declaring that its turnover was £190,000. • On 12 June 2020 the BBL of £45,000 was received into Stirling’s bank account. • Accounting records show that Stirling’ s turnover for YE 31 August 2020 was £57,499. • Bank records for Stirling show that its first income was on 23 March 2020 and its turnover between then and the BBL application on 10 June 2020 was £9,276. • The amount of BBL that Mr Sultani could have applied for on behalf of Stirling under the BBL scheme was at most £14,375. Therefore, Stirling received £30,625 more than it was entitled to under the BBL scheme. • Between 21 July 2021 and 21 February 2023 £15,174 of the £45,000 BBL was repaid by Stirling. • On 08 March 2023 Sterling entered Creditors Voluntary Liquidation with total liabilities of £30,199 the entirety of which relates to the outstanding BBL.
