Conduct: On 12 May 2020, Graeme Horne (“Mr Horne”) caused Total Logistix Ltd (“TLL”) to receive a second Bounce Back Loan (“BBL”) of £45,000 contrary to the terms of the BBL scheme which Mr Horne knew or should have known that TLL was not entitled. In that: • Under the BBL scheme eligibility, a borrower is required to declare that this is their only application for a BBL, it is not in the process of applying for or has already received a Bounce Back Loan Scheme facility. The eligibility criteria stated that the maximum a business could be loaned was £50,000. • TLL was incorporated on 29 September 2017. • Mr Horne applied for a £45,000 BBL from Lender A which was deposited into the company bank account held with the lender on 5 May 2020. • Mr Horne stated in the application to Lender A that TLL’s turnover was £180,000. Based on this turnover the maximum BBL TLL was entitled to was £45,000. • Mr Horne applied for a second BBL, from Lender B for £45,000 which was deposited into the company bank account held with the Lender B on 12 May 2020, when it was not entitled to do so. • Mr Horne confirmed to lender B that “I/We confirm that this is my/our only application for a Bounce Back Loan for this business, and I am/We are not part of a wider group which is in the process of applying for or has already received a Bounce Back Loan”. • On 20 September 2024 TLL entered liquidation with current total liabilities of £274,935 of which £67,297 is owed to both BBL’s
