Conduct: For purpose of settlement only as conveyed to BP on 7/5/2026 and revised DQ UT issued on 22/6/2026: On 04 May 2020, I caused Dalkeith Apartments Ltd (“Dalkeith”) to apply for and obtain a Bounce Back Loan (“BBL”) of £50,000 that Dalkeith was not entitled to by overstating the estimated turnover on the BBL application. As a result, Dalkeith received £47,284 more than it was entitled to, in that: ? Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated annual turnover. These funds were to be used for the economic benefit of the company. ? Dalkeith was incorporated on 07 March 2017. The accounts to 31 March 2018 state the principal activity during the period was the refurbishment and management of a hotel. The same accounts confirm the hotel as an asset and detail creditors due. On 7 March 2019 Dalkeith entered into leases with third parties in relation to part of the building; ? Dalkeith’s financial accounts for the year ending 30 March 2019 declared nil turnover. ? Dalkeith’s financial accounts for the period of 01 April 2019 to 30 September 2020 declared a turnover of £10,864 for the 12-month period ending 31 March 2020. ? Therefore, Dalkeith was eligible to apply for a maximum BBL of £2,716. ? On 04 May 2020, I applied for a £50,000 BBL on behalf of Dalkeith stating the estimated annual turnover of Dalkeith for the year 2020 as £760,000. ? On 05 May 2020, Dalkeith received BBL funds of £50,000 into Dalkeith’s bank account. ? Dalkeith made 19 BBL repayments totalling £11,549.36 during the period 06 December 2021 to 05 April 2023. ? On 12 April 2023, Dalkeith entered administration with liabilities of £3,233,436.78, of which £41,899.20 was owed in respect of the BBL. Allegation issued in proceedings: On 04 May 2020, Alexander O’Hara McQuade (“Mr McQuade”) caused Dalkeith Apartments Ltd (“Dalkeith”) to apply for and obtain a Bounce Back Loan (“BBL”) of £50,000 that Dalkeith was not entitled to either by way of the company having been established prior to 1 January 2019 therefore not being eligible to estimate turnover and having a turnover of nil for the calendar year 2019, or being established at 7 March 2019 at the latest and therefore having a full years turnover figure available to it at the date of the BBL application on 4 May 2020 of £10,864 and therefore overstating its turnover. As a result, Dalkeith received more BBL funds than it was entitled to, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The same accounts confirm the hotel as an asset and detail creditors due. • On 7 March 2019 the company entered into leases with third parties in relation to part of the hotel. • The company’s financial accounts for the year ending 30 March 2019 declared nil turnover. • The company’s financial accounts for the period of 01 April 2019 to 30 September 2020 declared a turnover of £10,864 for the 12-month period ending 31 March 2020. • On 04 May 2020, Mr McQuade applied for a £50,000 BBL on behalf of Dalkeith stating the company’s annual turnover as £760,000. • On 05 May 2020, Dalkeith received BBL funds of £50,000 into the company’s bank account. • Therefore, if the company was eligible for a BBL at all, it was eligible to apply for a maximum BBL of £2,716 being 25% of £10,864 receiving at least £47,284 too much BBL funds. • The company made 19 BBL repayments totalling £11,549.36 during the period 06 December 2021 to 05 April 2023. • On 12 April 2023, Dalkeith entered administration with liabilities of £3,233,436.78, of which £41,899.20 was owed in respect of the BBL.
