Conduct: In May 2020, Barry Wilson (“Mr Wilson”) caused Larch Joiners and Builders Limited (“LJB”) to apply for a Bounce Back Loan (BBL) of £50,000 using overstated turnover figures in the application form and as a result LJB has received at least £34,100 more that it was entitled to, in that: • A business could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover in calendar year 2019 or where a business was established after 1 January 2019, it is their estimated turnover from the date the business started. • LJB was incorporated and commenced trading on 24 February 2017, therefore was not able to apply for a BBL based on its estimated turnover. • Mr Wilson applied for and obtained a BBL of £50,000 in May 2020 and stated the annual turnover for LJB was £200,000. • On 29 May 2020 the BBL of £50,000 was deposited into the company bank account held with the lender of LJB. • Company accounts for Year Ended 29 February 2020, disclose company turnover for Year Ended 28 February 2019 to be £44,418 and for Year Ended 29 February 2020 to be £53,426. • The company bank account statements show Calendar Year 2019 from 7 January 2019 to 9 December 2019, trade/sales activity of £63,603. Therefore, the maximum funds the company was entitled to was £15,900 • On 26 May 2023, LJB entered Creditors Voluntary Liquidation with known liabilities of £46,185 which is owed in respect of the BBL.
