Conduct: On 27 January 2021, Levent Erdem (“Mr Erdem”) caused The Parkway Catering Ltd (“Parkway”) to apply for a Bounce Back Loan (BBL) of £50,000 that he knew or ought to have known Parkway was not eligible for, as it had ceased trading in February 2019. The funds received from the BBL scheme were not used for the economic benefit of the company, in that: • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover. Borrowers were required to declare that the business was engaged in trading or commercial activity in the UK at the date of the application and was carrying on business on 1 March 2020. The funds could only be used to provide economic benefit to the company and not for personal purposes. • The last company’s financial accounts were filed at Companies House on 17 August 2018 for year ending 31 August 2017, • Parkway’s bank statements show that, prior to the receipt of BBL, the last payment into Parkway’s bank account was made on 05 February 2019 and Parkway’s entire income in 2019 was totalling £1,627, • Prior to obtaining the BBL Parkways Bank Balance was £8 • In the BBL application form dated 27 January 2021, Mr Erdem stated that the Company turnover was £450,000, when applying for a BBL of £50,000, • On 02 February 2021 a BBL of £50,000 was paid into Parkway’s bank account, • Parkway did not trade following receipt of the Bounce Back Loan; and between 02 February 2021 and 28 August 2021, transactions totalling £49,904 were made from the company’s bank account: - Card payment totalling £36,905 - ATM withdrawals totalling £7,250 - Self Withdrawal totalling £3,000 - Bank Transfers totalling £2,750 • On 17 July 2024 Parkway entered liquidation with liabilities totalling £98,370 of which £50,409 was in relation to BBL.
