Conduct: On 9 July 2020 Mr Peter McGregor Lamb (PML) caused McGregor Haulage Limited (MHL) to breach the conditions of the Bounce Back Loan ("BBL") facility by applying for a BBL of £50,000 when he knew or ought to have known that MHL was not entitled to the loan having previously applied for a BBL of £50,000 on 1 July 2020. Under the BBL scheme businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’s turnover. Only one loan was available to businesses.?? ? PML made an application for a BBL of £50,000 on behalf of MHL on 1 July 2020 using a Turnover of £1,626,119. The BBL funds were paid into MHL’s bank account on 17 July 2020.??? ? PML made a further BBL application of £50,000 on behalf of MHL on 9 July 2020?? ? PML signed the declaration on the application form and BBL agreement on 9 July 2020 confirming that MHL had not applied for any other BBL.? ? The funds from MHL’s second BBL were paid into its bank account on 13 July 2020? Total liabilities at liquidation amount to £198,215 of which £72,492 relates to amounts owed in respect of the 2 BBLs.
