Conduct: Mrs Besey Parlak (“Mrs Parlak”) breached her duties as a director of Berk Fish Bar Limited (“Berk”) trading as Smart Fish Bar by failing to ensure that it complied with legislative requirements, in that: • Berk did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 resulting in the employment of 2 people who did not have the right to work or, the right to work for the tasks they were performing. • Home Office Immigration Enforcement (“HOIE”) carried out a visit to Berk’s trading premises on 29 October 2024 and, as a result, issued Berk with a Notice of Liability for a Civil Penalty on 20 January 2025 in the sum of £80,000 in respect of the employment of two workers, payment of which was due on or before 19 February 2025. • Berk did not pay the penalty due to HOIE which remained outstanding in full at liquidation. At Liquidation on 12 May 2025, Berk had liabilities of £89,964, of which £80,000 relates to the outstanding civil penalty. • Mrs Parlak was the appointed director of the company at the time of the breach of the Immigration, Asylum and Nationality legislation
