Conduct: Alexander Richard Barnes ("Mr Barnes"), as director of Alex Construction Tech Ltd ("Alex"), caused Alex to dispose of assets belonging to hire companies without authorisation, in that: • Between 01 October 2023 and 31 May 2024, at Canterbury in the county of Kent, Mr Barnes committed fraud in that he dishonestly made a false representation, namely ordering tools with the intention to sell them, without having any intention to make payment for the items, intending to make a gain, namely financial, for himself • Between 01 August 2023 and 30 August 2023, at Manchester in the county of Greater Manchester, Mr Barnes committed fraud in that he dishonestly made a false representation, namely ordering tools with the intention to sell them, without intending to provide payment for said tools, intending to make a gain, namely financial, for himself • On 31 July 2024 Alex was wound up in the High Court of Justice Business and Property Courts of England and Wales with total liabilities of at least £170,142 • On 25 September 2025 Mr Barnes was convicted of two counts of fraud by false representation after pleading guilty at Folkestone Magistrates Court • Mr Barnes was sentenced to 8 months' imprisonment, concurrent on each count, suspended for 18 months and was required to repay the financial losses suffered by the hire companies due to his fraudulent activity, which totalled £33,884.32
