Conduct: Mrs Zeynep Safiye Kirvak-Taylor (“Mrs Kirvak-Taylor”) breached her duties as the director of Zeynep Tacos Locos Sittingbourne Ltd (“ZTLS”) by failing to ensure that it complied with its legislative duties, in that: • Home Office Immigration Enforcement carried out a visit to ZTLS’s trading premises on 29 June 2023 and, as a result, issued a Notice of Liability for Civil Penalty on 17 January 2024, amounting to £40,000 in respect of the employment of four workers, which was due for payment on or before 14 February 2024. • ZTLS accepted full liability for the penalty and requested a payment plan extending over 48 months rather than the offered 36 months, lodging an appeal on 18 March 2024 when the proposed payment plan was not accepted. • The Appeal was dismissed on the agreement that Mrs Kirvak-Taylor paid the full penalty amount over a period of 48 months with the first instalment due on 01 September 2024. • No payments were made towards the penalty. • Mrs Kirvak-Taylor has failed to provide sufficient records to evidence that ZTLS carried out proper checks in compliance with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (“the 2006 Act”) resulting in the employment of four people who did not have the right to work, or the right to work for the tasks they were performing. Mrs Kirvak-Taylor was the sole director of the company at the time of the breaches of the 2006 Act. • The Penalty remains unpaid. At liquidation on 15 November 2024, ZTLS had liabilities of £88,162 of which £40,000 relates to the outstanding civil penalty.
