Conduct: Mr Musa Kivrak (“Mr Kirvak”) breached his duties as the director of Musa Tacos Locos Canterbury Ltd (“MTLC”) by failing to ensure that it complied with its legislative duties, in that: • Mr Kivrak has failed to provide sufficient records to evidence that MTLC carried out proper checks in compliance with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (“the 2006 Act”) resulting in the employment of one person who did not have the right to work, or the right to work for the tasks they were performing. • Mr Kivrak was the sole director of the company at the time of the breaches of the 2006 Act. • Home Office Immigration Enforcement carried out a visit to MTLC’s trading premises on 9th August 2023 and, as a result, issued a Notice of Liability for Civil Penalty on 13th September 2023, amounting to £10,000 in respect of the employment of one worker, which was due for payment on or before 13th October 2023. • MTLC lodged an objection to this penalty on 5th October 2023, but Home Office Immigration Enforcement rejected this appeal and notified MTLC that the Civil Penalty remained due to be paid by 14th November 2023 • No payments were made towards the penalty.
