Conduct: Mahdi Syahtab (“Mr Syahtab”) breached his duties as a director of Kandoo Restaurant Limited ("Kandoo") by failing to ensure that it complied with legislative requirements in that: • Kandoo did not comply with its’ statutory obligations under the Immigration, Asylum and Nationality Act 2006 (IANA 2006) by employing two individuals who did not have the required right to work in the UK; • Following an investigation, Home Office Immigration Enforcement (HOIE) issued a Notification of Liability for a Civil Penalty in the sum of £80,000, in respect of Kandoo’s employment of these workers; • Payment of this penalty was due on or before 24 April 2024; • Kandoo appealed the Civil Penalty Notice however, this appeal was struck out; • Kandoo failed to make any payment towards the civil penalty, and the full amount of £80,000 remained outstanding at liquidation; and, • Mr Syahtab was an appointed director of Kandoo at the time of the breach of the Immigration, Asylum and Nationality legislation.
