Conduct: 1. Mr Mohammed Lukman Khalil (‘Mr Khalil) breached his duties as the director of Burgerteam Limited (‘the Company’) by failing to ensure that it complied with its legislative duties, in that: • The Company did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (‘the Act’) resulting in the employment of 2 individuals who did not have the right to work in the UK; • Home Office Immigration Enforcement carried out a visit to the Company’s trading premises on 31 May 2023 and as a result issued a Notice of Liability for Civil Penalty on 6 October 2023, amounting to £30,000 in respect of the employment of 2 workers, which was due for payment on or before 07 November 2023; • The penalty remains unpaid. • Mr Khalil was the sole director of the Company at the time of the breach of the Act. 2. Mr Khalil failed to ensure that the Company maintained and/or preserved adequate accounting and administrative records, or in the alternative he failed to ensure that such records as were maintained were delivered to the liquidator. In the absence of full records, it has not been possible to: o Ascertain the reason for cash withdrawals totalling £38,447 made on the Company’s account and verify that these were all legitimate company expenditure (or was accounted for in a director’s loan account); o The lack of records has also meant that it has not been possible to consider the Company’s policies and procedures in which were in place when conducting Right to work(“RTW”) checks and / or if those procedures were adequate. o Further it has not been possible to establish if any RTW checks were conducted in relation to the employment of the illegal workers found at the Company’s premises on 31 May 2023.
