Conduct: Mr Harjinder Singh Sandhu (“Mr Sandhu”) breached his duties whilst acting as a director of Blue Pearl (Grantham) Ltd (“Blue Pearl”) by failing to ensure that it complied with its legislative duties, in that: • Home Office Immigration Enforcement (“HOIE”) visited Blue Pearl’s trading premises on 11 July 2024 and, after investigating the company, issued a Notice of Liability for Civil Penalty of £80,000 on 26 September 2024, in respect of the employment of two workers, which was due for payment on or before 28 October 2024. • Mr Sandhu has failed to provide sufficient records to evidence that Blue Pearl carried out proper checks in compliance with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (“the 2006 Act”) resulting in the employment of two people who did not have the right to work or, the right to work for the tasks they were performing. Mr Sandhu was the sole director of the company at the time of the breaches of the 2006 Act. • Blue Pearl has not paid the penalty due to HOIE and has therefore not complied with its requirements under the 2006 Act. At Liquidation on 24 February 2025, Blue Pearl had liabilities of £183,963, of which £80,000 relates to the outstanding civil penalty.
