Conduct: Mr Nazim Uddin (“Mr Uddin”) breached his duties whilst acting as a director of Balti Tandoori Restaurant Limited (“Balti”) by failing to ensure that it complied with its legislative duties, in that: • Home Office Immigration Enforcement carried out a visit to Balti’s trading premises on 11 July 2023 and, as a result, issued a Notice of Liability for Civil Penalty on 11 December 2023, amounting to £15,000 in respect of the employment of one worker, which was due for payment on or before 10 January 2024. • After consideration of an objection submitted by Mr Uddin, received on 15 January 2024, the Civil Penalty was upheld, payment of which was due immediately. • Home Office Immigration Enforcement carried out a second visit to Balti’s trading premises on 25 July 2024 and, as a result, issued a Notice of Liability for Civil Penalty on 11 September 2024, amounting to £120,000 in respect of the employment of two workers, which was due for payment on or before 11 October 2024. • Mr Uddin has failed to provide sufficient records to evidence that Balti carried out proper checks in compliance with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (“the 2006 Act”) resulting in the employment of three people who did not have the right to work or, the right to work for the tasks they were performing. Mr Uddin was the sole director of the company at the time of the breaches of the 2006 Act. • Balti paid £600 towards the first penalty issued. The second penalty remains fully unpaid. At Liquidation on 13 August 2025, Balti had liabilities of £220,185, of which £132,673 relates to the outstanding civil penalties.
