Conduct: Mr Syed Zoqeer Shah (“Mr Shah”) caused Yorkshire Catering Machines Ltd (“Yorkshire”) to breach compliance with its statutory obligations under The Immigration, Asylum and Nationality Act 2006. This resulted in the employment of a person who did not have the right to work in the UK. In that: • Employers are required to check that individuals are allowed to work in the UK before they employ them. If a worker’s right to work is time-limited, employers are required, to re-check that the worker is continued to be allowed to work in the UK. • On 18 September 2024 the Home Office Immigration Enforcement (“HOIE”) identified that a worker employed by Yorkshire had no right to work in the UK. • On 8 January 2025 the Home Office issued a Notification of Liability for Civil Penalty of £40,000 in respect of the employment of the worker, payment of which was due on or before 7 February 2025. • Home Office have determined that Yorkshire did not correctly carry out the prescribed right to work checks as set out in the Code of Practice on preventing illegal working. The code states holders of a Biometric Residence Permit (“BRP”) can only evidence their right to work using the Home Office online service. As such a physical BRP cannot be used as proof of a right to work. • Mr Shah has not provided any evidence to show that Yorkshire Catering conducted the prescribed “right to work checks” in respect of the worker. • The Company has not paid the Penalty due to HOIE. • Mr Shah was the sole appointed director of Yorkshire at the time of the breach of the Immigration, Asylum and Nationality legislation. • At Liquidation on 19 June 2025, Yorkshire had liabilities of £177,000.00 of which £40,000 related to the outstanding civil penalty.
