Conduct: Mrs Marina Marino (“Mrs Marino”) breached the terms of the Bounce Back Loan (“BBL”) Scheme by causing Pasta&Bread Limited (“Pasta”) to make a false representation in its application for a BBL of £50,000, when Mrs Marino knew or ought to have known that Pasta did not meet the eligibility criteria to obtain a BBL in that: To be eligible for a BBL, businesses were required to have been engaged in trading or commercial activity in the UK at the date of the application, be carrying on business on 01 March 2020 and to have been adversely affected by Covid-19. Pasta was incorporated on 10 March 2020. On 02 October 2020, Mrs Marino made an application for a BBL of £50,000 on behalf of Pasta. Mrs Marino declared that the company was carrying on business on 01 March 2020. Due to the fact that Pasta was not carrying on business on 01 March 2020, Pasta did not meet the eligibility criteria to apply for a BBL. Mrs Marino’s false declaration resulted in Pasta receiving £50,000, that it wasn’t entitled to receive. Total liabilities at liquidation amount to £49,000 of which £48,000 relates to the amount owed in respect of the BBL.
