Conduct: On 22 June 2020, Mr Abbas Cenk Sen (“Mr Sen”) caused Equinox Fish Bar (Wallington) Ltd, (“Equinox”) to obtain a government-backed Bounce Back Loan (“BBL”) of £50,000 when he knew or ought to have known Equinox was not eligible for that amount, in that: • The terms of the BBL Scheme stated that a business could apply for a loan of up to 25% of the Company’s turnover, from a minimum of £2,000, up to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover. In either case, the applicant business must have been carrying on business and engaged in commercial activity by the date of the application. • Equinox was incorporated on 25 February 2020, and Mr Sen was appointed as its director on the same date, remaining in office until liquidation. • A precondition of eligibility for a BBL was that the applicant company had been carrying on business on or before 01 March 2020 and had suffered economic detriment as a result of the Covid-19 pandemic. • There is no evidence of Equinox having been carrying on its business in the 5-day period between incorporation on 25 February 2020 and 01 March 2020. • According to its bank, Equinox did not apply for and open its bank account until 08 March 2020. When applying to the bank to open the account, Mr Sen told the bank that Equinox’s turnover was £80,000. • On 22 June 2020, Mr Sen submitted a BBL application to Equinox’s bank declaring an estimated annual turnover of £200,000 and requesting a BBL of £50,000. • On 23 June 2020, the BBL of £50,000 was credited to Equinox’s bank account. • According to its bank statements, Equinox received no trading income prior to the BBL application nor subsequently until April 2022. • Equinox made BBL repayments of £10,085.88 • Equinox entered Creditors’ Voluntary Liquidation on 4 June 2024 • The bank has filed a claim in the liquidation of £43,063 in respect of the BBL.
