Conduct: On 12 February 2021, Robin William Matthew Lumley - Saville (‘Mr Lumley-Savile’) caused Trika Ltd (‘Trika’) to breach the terms and conditions of the Bounce Back Loan (‘BBL’) scheme by applying for a BBL of £50,000 that he knew or ought to have known that the company was not eligible for. Furthermore, Mr Lumley-Savile failed to ensure that the entirety of the BBL funds were used for the economic benefit of Trika, in that: • Under the BBL scheme, businesses could apply for one loan of between £2,000 and £50,000, subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or, where a business was established after 01 January 2019, an estimated turnover could be used. • Applicants were required to declare, amongst other things, that the business was engaged in trading or commercial activity in the UK at the date of the BBL application, was carrying on business on 01 March 2020, and has been adversely affected by coronavirus (COVID-19). The terms and conditions of the BBL scheme stated that the loan was to be used to provide economic benefit to the company, wholly for business purposes and not personal purpose. • On 12 February 2021Trika applied for a BBL of £50,000, declaring an annual turnover of £225,000. The application was signed by Mr Lumley-Savile as director of Trika. • Trika was incorporated on 20 February 2020. The company was not engaged trading or commercial activity on 01 March 2020. • Available statements for Trika’s bank account, dated from 20 October 2020, where there was a zero balance, to 17 February 2021, record three credit transactions totalling £416 from Mr Lumley-Savile. • On 17 February 2021, Trika received the £50,000 BBL funds into the company bank account. Between 17 and 19 February 2021, £47,500 of the BBL funds were transferred to Mr Lumley-Savile and £2,500 went to a third party. • On 10 May 2024 a Winding Up petition was presented against Trika. The Winding Up order was made on 26 June 2024. • At liquidation, Trika owed £55,061 in respect of the outstanding BBL.
