Conduct: On 06 July 2020, Asabur Rahman (“Mr Rahman”) caused Jibon Spice Ltd (“JSL”) to apply for a Bounce Back Loan (“BBL”) of £50,000 when he knew, or ought to have known that the company was not eligible for the loan scheme and has failed to use the BBL funds for the economic benefit of JSL. In that: Under the BBL scheme, businesses were able to apply for a BBL if they were carrying on business on 1 March 2020, engaged in trading activity in the UK at the date of the BBL application and had been adversely impacted by Coronavirus. On 06 July 2020 Mr Rahman applied for a BBL of £50,000 on behalf of JSL, stating an estimated turnover figure of £210,000 on the application form. JSL was incorporated on 10 February 2020 and filed dormant accounts for the financial year ending 28 February 2021. The first deposit of business income can be seen on the bank statements on 24 June 2020. JSL was not therefore carrying on business or engaged in trading activity on 01 March 2020, and as such was not eligible to apply for a BBL of any amount. The company received the BBL funds of £50,000 on 28 September 2020. Mr Rahman has failed to provide any evidence to show that the BBL funds have been used for the economic benefit of WPL, contrary to the BBL terms and conditions. JSL entered Creditors Voluntary Liquidation on 15 July 2022. At liquidation, JSL had liabilities totalling £50,000, of which £49,237.83 was owed to the bank in respect of the BBL.
