Conduct: Allegation Diana-Ionela Citea (“Ms Citea”) caused Dia Care Services (“DCS”) to make a wrongful application for a Bounce Back loan (“BBL”) of £50,000 using an estimated annual turnover which she knew, or ought to have known, was false, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 1 January 2019 it was their estimated turnover. • DCS was incorporated on 21 January 2020, and Ms Citea was therefore entitled to estimate DCS’ annual turnover from the date the company commenced trading. • Ms Citea completed a BBL application in which she estimated DCS’s annual turnover at £200,000, and therefore applied for a BBL of £50,000 which was paid into the company account on 02 September 2020. • DCS had one contract, through which Ms Citea provided care services to a client. • By applying the highest weekend rate paid to DCS over 365 days would result in an annual turnover of £96,000 • Based on annual turnover of £96,000, DCS was entitled to apply for a loan of £24,000, and therefore received at least £26,000 more than it was entitled to. • Bank statements show that annual income received from this contract was £29,667 • DCS made repayment of £6,174 • DCS entered Creditors’ Voluntary liquidation on 13 March 2023, £44,981 remained outstanding in respect of the BBL.
