Conduct: On 25 June 2020 Ms Thi Kim Phuong Doan (“Ms Doan”) caused DOAN HEALTH & BEAUTY LTD (“DHBL”) to obtain a Bounce Back Loan (“BBL”) of £50,000 using an overstated turnover figure, which resulted in DHBL obtaining a BBL that it wasn’t entitled to. Ms Doan failed to provide adequate evidence that £14,344 of the funds used were for the economic benefit of the company, contrary to the terms and conditions of the BBL. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover from the date trading commenced. • DHBL was incorporated on 14 January 2020 and commenced trading on or around that date. • On 25 June 2020, Ms Doan applied for a BBL of £50,000 on behalf of DHBL declaring an estimated turnover of £210,000. • DHBL received the BBL funds of £50,000 on 29 June 2020. • DHBL’s bank account showed no income prior to receipt of the BBL funds and Ms Doan has failed to produce any evidence to support how she estimated turnover at £210,000 • Between 06 July 2020 and 08 September 2020, Ms Doan received £24,900 of the BBL funds. Ms Doan has failed to provide any evidence to verify whether BBL funds amounting to £14,344 were used for the economic benefit of DHBL. • Total liabilities at liquidation amount to £50,550 of which £50,000 relates to the amount owed in respect of the BBL.
