Conduct: On 25 July 2020, Suleyman Ata (“Mr Ata”) caused 599 GG Limited (“5GG”) to apply for a Bounce Back Loan (“BBL”) of £50,000 when 5GG was not eligible for this amount, making a false declaration to the lender of 5GG’s turnover, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated annual turnover from the date the business started. • 5GG was incorporated on 13 January 2020 and intended to trade as a restaurant. At the end of January 2020, the company decided to sublet the premises instead. A sublease was agreed with a third party on 15 February 2020, commencing immediately. Rent of £10,000 per month was agreed. • Based on the company’s expected income of £120,000 per year from sublease rents, 5GG was eligible to apply for a maximum BBL of £30,000. • On 25 July 2020, Mr Ata applied for a £50,000 BBL on behalf of 5GG, declaring the company’s estimated annual turnover as £1million. • On 27 July 2020, BBL funds of £50,000 were received into the company’s bank account. • On 30 November 2022, 5GG entered creditors voluntary liquidation. Total liabilities at liquidation amount to £190,375 of which £42,432 is in respect of the BBL. The remainder relates to trade and expense creditors (£144,343) and Directors Loan Account (£3,600).
