Conduct: On 07 October 2020, Mr Md Abdul Monir (“Mr Monir”) caused RS & Associates Ltd T/A Sushi Lane Japanese Kitchen (“RSA”) to make a Bounce Back Loan (“BBL”) application of £50,000 when he knew or ought to have known that RSA was not eligible for the BBL, as RSA was not engaged in trading or commercial activity on 01 March 2020 or at the date of the BBL application. In that: • Under the BBL scheme businesses met the eligibility criteria if they were engaged in trading or commercial activity in the UK at the date of the application and were carrying on business on 01 March 2020. • RSA was incorporated on 03 January 2020.  • On 07 October 2020, Mr Monir applied for a BBL of £50,000 on behalf of RSA declaring that its estimated turnover was £300,000.  • On 07 October 2020, Mr Monir opened a bank account on behalf of RSA. • On 08 October 2020, the £50,000 BBL funds were received into RSA’s bank account. • Mr Monir informed the Liquidator that RSA commenced trading in December 2020. • On 28 June 2022, RSA entered Creditor’s Voluntary Liquidation with total liabilities of £70,892.32, of which £50,907.39 was owed in respect of the BBL.
