Conduct: On 13 May 2020 Thomas Geoffrey Haley (“Mr Haley”) caused Bright House Maintenance Ltd (“BHM”) to apply for and obtain a Bounce Back Loan (BBL) when he knew, or ought to have known, that BHM did not meet the criteria for the loan, Furthermore the BBL funds received were not used for the economic benefit of BHM, in that: • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover. • The Bounce Back Loan eligibility criteria was that a business was established and actively trading at 01 March 2020, was engaged in commercial activity at the date of the BBL application and had been adversely affected by COVID-19. • Mr Haley applied for a £50,000 BBL on 13 May 2020. This was paid into the company bank account on 14 May 2020 • BHM was incorporated on 23 December 2019, however the company bank statements show that the first transaction was on 14 May 2020 and was the £50,000 BBL being credited to the account. Therefore, the company was not active and operating on 01 March 2020 or engaged in commercial activity at the date of the BBL application and was not eligible to receive a BBL. • Full accounts for the year ended 31 December 2020 and 31 December 2021 show a nil turnover. • The BBL scheme provided that the BBL could only be used for the economic benefit of the business. • £25,958 of the loan was transferred to two connected companies and payments of £21,600 were made however there is no evidence provided to show that BHM benefitted from this. • BHM made BBL repayments of £4516 • BHM entered Creditors’ Voluntary Liquidation on 28 September 2023 • At liquidation, £46,374 of the £50,000 BBL was still outstanding.
