Conduct: Mr Devi Gamtsemlidze (“Mr Gamtsemlidze”) caused Devis Ductwork Services Ltd (“DDS”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by applying for a BBL when you knew or ought to have known that DDS was not eligible for the scheme, and failing to use at least £41,500 of the £50,000 obtained for the economic benefit of DDS. In that: in that: • Under the BBL scheme an applicant was required to confirm that the business was carrying on business on 01 March 2020 and engaged in trading or commercial activity in the UK at the date of the application. • On 21 March 2021, Mr Gamtsemlidze applied, on behalf of DDS for a BBL of £50,000 declaring a turnover of at least £200,000. • DDS was incorporated on 17 December 2019 • DDS’s bank account was opened on 02 March 2021. • The only transaction into the bank account prior to the BBL was on 02 March 2021 for £393. • The Year End Accounts for 30 November 2020 show that DDS was dormant. • Mr Gamtsemlidze has not provided evidence to show that DDS was carrying on business on 01 March 2020 and engaged in trading or commercial activity in the UK at the date of the application or explanation for the turnover figure stated. • Under the BBL scheme an applicant was required to also confirm that BBL funds received would only be used to provide economic benefit to the company. • Of the £50,00 BBL funds received £28,058 was transferred to Mr Gamtsemlidze, £8,334 to unknown person, and a money transfer of £5,108 contrary to the terms of the scheme. • Total liabilities at liquidation amount to £55,707 of which £50,626 relates to the amount owed in respect of the BBL.
