Conduct: On 19 September 2020 Christina Roxana Simion (“Miss Simon”) caused EMANUEL-GABRIEL LTD (“EGL”) to apply for a Bounce Back Bounce back loan (“BBL”) of £50,000 using overstated turnover figures and wrongly declaring that EGL was trading on 1 March 2020 and at the time of BBL application which resulted in EGL obtaining a BBL that it was not entitled to. Miss Simon caused EGL to expend £50,000 of BBL funds which did not provide economic benefit to EGL in breach of the terms and conditions • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover from commencement of trade. The company was engaged in trading or commercial activity in the UK at the date of the application, was carrying on business on 1 March 2020 and had been adversely affected by Coronavirus • EGL was incorporated on 19 December 2019 • Bank statements covering period 17 December 2019 to 19 September 2020 show that EGL had credits totalling £241 • Bank statements show that activity on the account commenced from April 2020. £10 credited on 3 April 2020 and £231 on 5 May 2020 • On 19 September 2020, Miss Simion applied for a BBL of £50,000 on behalf of EGL declaring that its turnover for the calendar year 2019 was £212,850 and that it was trading on 1 March 2020. • EGL received the BBL funds of £50,000 on 21 September 2020 • Between 23 September 2020 and 11 March 2021 payments totalling £50,000 were made from EGL bank account which did not provide economic benefit to EGL. • No financial accounts have been submitted for EGL • Total liabilities at liquidation amount to £50,601 of which £50,000 relates to the amount owed in respect of the BBL.
