In that: • J&T submitted an application for a BBL in the sum of £49,000 on or around 07 September 2020. BBL funds in the sum of £49,000 were subsequently received into J&T's bank account on 08 September 2020; • When making a BBL application the applicant was required to declare that their company was trading as at 01 March 2020 and was also engaged in trading as at the date of the BBL application; • J&T was incorporated on 04 December 2019 but does not appear to have commenced trading until September 2020; • J&T's bank statements do not record any trading for the period before receipt of the BBL on 08 September 2020. Further, the initial transaction on the bank account was the receipt of the BBL funds; • Mr Ireland confirmed that J&T did not commence trading until 01 September 2020; • J&T was therefore not entitled to a BBL in any amount as it was not trading as at 01 March 2020 and received £49,000 more in BBL funding than it was eligible to receive; • The bank has filed a Proof of Debt in the liquidation in the sum of £42,398.16 in respect of the outstanding BBL balance.
