Conduct: On 28 October 2020 David Lindsay Eccles (“Mr Eccles”) caused Contract Cleaning Services (Northern) Limited (“Contact Cleaning”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application when he know or ought to have known that Contract Cleaning was not entitled to a BBL of £50,000 and as a result Contract Cleaning received more BBL funds that it was entitled to. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the application. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it is their estimated annual turnover from the date that the business was started. • Contract Cleaning was incorporated on 03 December 2019 and commenced trading in the same month. As such Contract Cleaning was able to estimate its annual turnover on the BBL application. • On 28 October 2020 Mr Eccles made a BBL application in the amount of £50,000 on behalf of Contract Cleaning, declaring turnover of £200,000 and on 30 October 2020 Mr Eccles signed the BBL agreement. On 01 November 2020, Contact Cleaning received the BBL funds of £50,000 into its bank account. • Contract Cleaning’s bank statements indicate that the bank account was opened on or around 18 June 2020. • Accounts for Contact Cleaning for the year ending 31 December 2020 and 31 December 2021 show turnover of £275 and £21,855 respectively. • As a result of Mr Eccles overstating Contract Cleaning ’s turnover on the BBL application form, the company received more BBL funding than it was entitled to. • Mr Eccles has not provided any evidence to support his estimation of Contract Cleaning’s turnover. • Contract Cleaning entered liquidation on 08 December 2024 with total liabilities of £77,487, of which £42,987 related to the amount owed in respect of the BBL including interest charged.
