Conduct: On 23 August 2020 Ms Haleema Emaan (‘Ms Emaan’) caused Surrey-UK Utilities Limited (‘SUU’) to apply for a Government-backed Bounce Back Loan (‘BBL’) of £45,000 for which it was not eligible and subsequently failed to ensure that the BBL proceeds were used in their entirety for the economic benefit of the business as required under the terms of the BBL scheme. In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), to a maximum of £50,000. • On 23 August 2020 Ms Emaan applied for a BBL of £45,000 for SUU, declaring estimated annual turnover of £190,000. • The only sales records provided for SUU were 2 invoices, dated 01 June 2020 and 01 July 2020. • The report to creditors states that SUU did not make its first sale until July 2020 and the first receipt into its bank account was not until 13 July 2020. • There is insufficient evidence to support an estimated turnover figure of £190,000 that Ms Emaan declared on the BBL application. • Following receipt of the BBL of £45,000 on 26 August 2020 the balance on SUU’s bank account increased to £55,985. • The terms of the BBL scheme required the proceeds to be used solely for the economic benefit of the business. • Between 10 November 2020 and 21 September 2021, when Ms Emaan resigned, £547 was paid into the account and payments totalling £20,610 were made to Ms Emaan; • No evidence has been provided that these payments were for the economic benefit of the business. • At the liquidation date £44,677 was outstanding in respect of the BBL.
