Conduct: From 28 November 2019, the date of her appointment onwards, Ilkay Hicran Naim (“Mrs Naim”) failed to ensure that Fenneck Design LTD (“FDL”) maintained or preserved adequate accounting records or in the alternative failed to deliver up such records to the liquidator. As a consequence it has not been possible to; • Determine what cash withdrawals totalling £105,355 between 17 March 2020 and 22 July 2020 were used for, if they were used for the benefit of the company or if any recoveries are available for the liquidator to pursue. • Determine the reason for 2 payments totalling £19,485 in June 2020 to “Third Party A” or if they were for the benefit of the company. “Third Party A” does not appear on the statement of affairs as a creditor in the liquidation. • Determine what 4 payments totalling £31,800 to “Third Party B” were for or if they were for the benefit of the company. The 4 payment entries in the bank statements carry invoice numbers, indicating that this was a supplier but it is not possible to confirm what was purchased, or for whom • Determine what 4 payments totalling £52,352 between 11 June 2020 and 29 July 2020 to “Third Party C” were for, if they were for the benefit of the company or if any recoveries may be pursued by the liquidator, • Determine what 4 receipts totalling £124,5112 between 13 March 2020 and 29 June 2020 from “Third Party D” were for, or if any further amounts are owed to the company. • Determine what 2 receipts totalling £25,701 in January 2020 from “Third Party E” were for or if any further amounts are owed from that company. • Determine what 2 receipts totalling £19,825 from “Third Party F” were for or if any further amounts are owed by that company. • Between 04 May 2020 and 07 September 2020 a total of £10,902 was claimed by the company under the governments Job Retention Scheme. In the absence of any wages records it is not possible to determine if the company was eligible for these grants. In addition it is not known how many employees FDL had and if their remuneration has been properly accounted for to HMRC for tax purposes. • FDL obtained a government backed Bounce Back Loan of £50,000 on 29 May 2020. In the absence of any books, records or accounts it is not possible to confirm that the company was eligible to apply for the loan or that it was used for the benefit of the company. • HMRC have claimed £22,192 in respect of VAT which was assessed in the absence of returns. It is not known if the amount assessed by HMRC for VAT is correct. • FDL entered liquidation on 18 November 2020 with no assets and liabilities as regards creditors of £80,649.
