Conduct: Stephen Cartwright (‘Mr Cartwright’) failed to ensure the proceeds of a Bounce Back Loan (“BBL”) secured by S C Precast Ltd (“Precast”) were used in their entirety for the economic benefit of Precast, in that: Precast applied for a £50,000.00 BBL on 19 September 2020, receiving the full amount into its bank account on 21 September 2020. Under the BBL scheme businesses were required to use the loan only to provide economic benefit to the business, and not for personal purposes and confirm they have understood the costs associated with repayment of the loan and that they are able and intend to complete timely repayments in future. Following receipt of the BBL Precast’s bank account had a credit balance of £61,460. Further credits of £10,798 were paid into Precast’s bank account. These funds related to HMRC JRS Grants, no income came from trading activities. Between 21 September 2020 and the closure of the account £66,847 was transferred to Mr Cartwright’s personal account, at least £27,742 of which came from BBL funds. Mr Cartwright has explained that these transfers were used to pay operatives but has not provided any evidence in support of this claim. At the date of Liquidation £49,519.00 of the BBL remained outstanding.
