Conduct: Azhar Ahmad (“Mr Ahmad”) breached the terms of the Bounce Back Loan (“BBL”) Scheme by causing Hussain & Sons Travel Limited (“H&S”) to overstate its turnover on its application for a BBL resulting in the company receiving a BBL of £50,000 when he knew or ought to have known that H&S was not eligible for a loan of that amount. In that:? The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.?? Companies established after 01 January 2019 were eligible to estimate their 2019 on the BBL application form from the date the business started. H&S was incorporated on 19 November 2019 and therefore entitled to estimate its turnover from November 2019 to November 2020. On 14 August 2020 Mr Ahmad declared on the company’s BBL application form an estimated annual turnover of £360,000, and consequently on 18 August 2020 H&S received a £50,000 BBL. Mr Ahmed stated he estimated H&S’ turnover based on forecasted accounts covering the period 19 November 2019 to 29 February 2020 showing a predicted turnover of £116,060 but has provided no evidence to support the forecast or estimated turnover which he declared on the BBL application. The only evidence of business income received is £1,400 into Mr Ahmad personal bank account between 28 November 2019 and 20 December 2019 and (excluding the BBL proceeds) one receipt of £75 into the company bank account between 17 June 2020 to 30 November 2020. H&S entered Creditors Voluntary Liquidation on 30 March 2022. At liquidation, H&S had liabilities totalling £61,000, of which £50,751.40 was owed to the bank in respect of the BBL.
