Conduct: On 17 May 2020 Javed Siddique (“Mr Siddique”) caused Galos Plymouth Ltd (“Galos”) to apply for a £30,000 Bounce Back Loan (BBL) when he knew, or ought to have known, that Galos did not meet the criteria for the BBL. In that: • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover. A company could apply for a loan which was up to 25% of its turnover in the calendar year 2019, from a minimum of £2,000, up to a maximum of £50,000. • The Bounce Back Loan eligibility criteria was that a business had to be engaged in trading or commercial activity in the UK at the date of the application, had to be carrying on business on 1 March 2020 and had to have been adversely affected by coronavirus (COVID-19). • Mr Siddique applied for a £30,000 BBL on 17 May 2020. This was paid into the company bank account on 19 May 2020 • Galos was incorporated on 06 November 2019. • Mr Siddique confirmed that the company did not start trading until July 2020. • The company bank statements show that the first transaction was on 30 April 2020 and was £50 paid in by Mr Siddique, and the second was the £30,000 BBL being credited to the account on 19 May 2020. Therefore, the company was not carrying on business at 01 March 2020 or engaged in commercial activity at the date of the BBL application and was not eligible to receive a BBL • At liquidation on 21 July 2023, £30,127 of the £30,000 BBL was still outstanding.
