Conduct: In November 2020, Michael Burns (“Mr Burns”) caused MBurns Automotive Ltd (“MB”) to apply for a Bounce Back Loan (“BBL”) of £20,000. Mr Burns then caused MB to apply for an additional £7,000 of BBL funds when he knew or ought to have known that MB did not meet the criteria for a BBL loan and was not entitled to any funds from the scheme. In that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover from the business started. • As per the BBL eligibility criteria, a business had to be established and actively trading at 01 March 2020. • MB was incorporated on 28 October 2019. • Companies House records show MB filed dormant accounts for the year ending 31 October 2020, which indicates that the company was not actively trading at 01 March 2020. • In November 2020, Mr Burns caused MB to apply for a BBL of £20,000. Mr Burns on behalf of MB, then applied for an additional £7,000 of BBL funds. • The first BBL payment of £20,000 was paid into the company’s bank account on 11 November 2020 and the second BBL payment of £7,000 was paid into the same bank account on 02 February 2021. • At liquidation on 25 July 2022, the BBL provider was the only company creditor with £27,430 outstanding.
