Conduct: Syuleyman Demirev (“Mr Demirev”) caused SD UK Services Ltd (“SD”) to breach the terms & conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover when he knew or ought to have known that SD was not entitled to a BBL of £50,000 based on its turnover, resulting in SD receiving more monies than it was entitled to. In addition, at least £25,000 of the BBL monies was not used for the benefit of the company. In that: - • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover for the 2019 calendar year or where a business was established after 01 January 2019 it is their estimated turnover from when the company began to trade. • The eligibility criteria was that a business was established and actively trading at 01 March 2020. • SD was incorporated on 18 October 2019. • In the BBL application form the turnover given for the 12 months since trading began was £200,890. • The BBL of £50,000 was paid into the company bank account on 08 January 2021. • Accounts for the period ending 31 October 2020 (the first 12 months of trading), which were signed by the director on 10 November 2020, show nil turnover. • A review of SD’s bank account shows following the receipt of the BBL payments totalling £25,000 were made to Mr Demirev which were not for the benefit of the company.
