Conduct: On 21 August 2020, John Awen (“Mr Awen”) provided misleading information in a Bounce Back Loan (“BBL”) application made on behalf of Ethical-Fest Ltd (“Ethical”) by overstating Ethical’s turnover, and by declaring that Ethical was carrying on its business on 01 March 2020, and was engaged in trading or commercial activity as at the date of the BBL application. As a result Ethical has received BBL funds of £50,000 that it was not entitled to, of which at least £15,744 have been expended for purposes that did not provide economic benefit to Ethical, in breach of the BBL terms and conditions.       • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover for the 12 months after the business started. To be eligible for the scheme, a business had to have been carrying on its business on 01 March 2020, and to have also been engaged in trading or commercial activity as at the date of the BBL application.   • Ethical was incorporated on 07 October 2019.    • On 21 August 2020, Mr Awen applied for a BBL of £50,000 on behalf of Ethical. The application asked Mr Awen to declare turnover for the calendar year 2019, or if the business was established after 01 January 2019, to estimate annual turnover from the date the business started. Mr Awen declared turnover for Ethical was £300,000. • In the BBL application, a number of declarations had to be made by the applicant. On 21 August 2020, Mr Awen falsely declared that Ethical was carrying on business on 01 March 2020, and that Ethical was engaged in trading or commercial activity on 21 August 2020.    • The bank account operated by Ethical was not opened until 20 August 2020. The first transaction on the bank account operated by Ethical was receipt of the BBL funds of £50,000 on 25 August 2020. Accounts for the financial year ending 31 October 2020 declare turnover of £1,000, which bank statements show was received between 17 September 2020 and 23 October 2020. As such, Ethical was not carrying on business as at 01 March 2020, and was not engaged in commercial or trading activity on 21 August 2020, when Mr Awen applied for the BBL. • Mr Awen declared turnover of £300,000 in the BBL application, when Ethical had received no sales as at the date of the BBL application. • The balance on the bank account of Ethical prior to receipt of the BBL was £0. Following receipt of the BBL funds on 25 August 2020, a payment of £4,500 was made to Mr Awen, and on 07 September 2020 a payment of £11,244 was made to a connected company. The payments, totalling £15,744 were not for the economic benefit of the company, and as such were in breach of the terms and conditions of the BBL scheme.   • Total liabilities at liquidation amount to £48,835 of which £47,960 relates to the amount owed in respect of the BBL.
