Conduct: On 17 July 2020, John Richard Bates (‘Mr Bates’) caused Hoverkart Mania Ltd (“Hoverkart”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overestimating Hoverkart’s turnover when applying for a BBL. As a result, Hoverkart received a £50,000 BBL when Mr Bates knew, or ought to have known, that Hoverkart was not eligible for a loan of that amount. In that:   • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it was their estimated annual turnover from the date the business started.     • Hoverkart was incorporated on 4 October 2019 and began trading on 4 November 2019. • On 17 July 2020, a BBL application was submitted by Mr Bates with an estimated turnover declared of £220,000. On 28 July 2020 the BBL funds of £50,000 were paid to the company’s bank account.     • Hoverkart’s takings spreadsheet provided to the Liquidator, shows income from incorporation to 17 July 2020 covering the 8 months of trading as £17,184. • Full accounts prepared for year-end 31 October 2020 show Hoverkart’s turnover to be £19,990. • The company was therefore entitled to obtain a maximum BBL of £4,975. • The overestimation of turnover by Mr Bates meant that Hoverkart received £45,025 more than it was entitled to from the BBL scheme. • Total liabilities at Liquidation amount to £51,279 of which £49,713 relates to the amount owed in respect of the BBL.
