Conduct: On 17 December 2020 Matt Bown (“Mr Bown”) caused REATCH Ltd ("REATCH") to apply for a bounce back loan (“BBL”) top-up using an over-estimated turnover which he knew or ought to have known was false, and contrary to the terms and conditions of the BBL scheme, subsequently failed to use all of the BBL funds received by REATCH for the economic benefit of the company. • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019, the estimated annual turnover from the date the business started. • REATCH was incorporated in October 2019 and commenced trading in February 2020; the company was therefore eligible to receive BBL funds based on estimated annual turnover from the date the business started. • On 04 May 2020 Mr Bown applied for a BBL on behalf of REATCH in the sum of £25,000, using an estimated annual turnover of £240,000 (“the initial application”). The funds were credited to the company’s bank account on 09 May 2020. • Accounts filed for REATCH’s year ending 31 October 2020 showed turnover of NIL. • On 17 December 2020 Mr Bown utilised the top-up scheme to request additional BBL funding of £25,000, with the funds being credited to REATCH’s bank account on 18 December 2020. REATCH had not generated any turnover prior to 17 December 2020. • The Agreement Terms with the lender required signatory declaration that information provided in the initial application had not become 'misleading or incorrect’. • In declaring that REATCH’s estimated annual turnover from the date the business started remained at £240,000 in the top-up application, Mr Bown used a figure which he knew or ought to have known was false. Consequently, REATCH received funds of £25,000 for which it was not eligible. • On 05 January 2021 £42,000 of the £50,000 BBL funds was transferred to Mr Bown's personal bank account. Of this amount, at least £26,570.00 was not utilised for the economic benefit of REATCH. • Repayments of £3,540.53 were made towards the BBL • At liquidation on 22 May 2023, £49,288.07 was owed to the lender in respect of the BBL.
