Conduct: On 17 June 2020, I caused Tuga Investments Ltd (‘TIL’) to breach the terms and conditions (‘T&Cs’) of the Bounce Back Loan (‘BBL’) scheme by overstating the turnover of TIL in a BBL application form, with the effect that TIL received a larger BBL than it was entitled to, in that: • TIL was incorporated on 20 September 2019, and the first banking transaction was dated 28 November 2019. • The BBL scheme T&Cs were detailed on the application forms, and required applicants to self-certify their annual turnover. If the business was established on or after 01 January 2019, as TIL was, it was entitled to estimate its annual turnover from the start date of business • On 17 June 2020, I signed the BBL application, self-certifying that TIL would have an estimated turnover of £204,356 and requested a BBL of £50,000 • Before the BBL application and between 28 November 2019 and 18 June 2020, TIL received deposits totalling £60 from a relative of mine. After 18 June 2020 to the date of liquidation, TIL received deposits totalling £407. The only other credit to the bank account was the £50,000 BBL on 18 June 2020. • On 30 May 2020, I stated that the expectation of a turnover of £204,356 was: o Based on a relative of mine contracting TIL to redevelop a property (‘the Property’) o That £204,356 was the minimum amount expected under the contract, with an expectation of £250,000 or more • My expectation of a turnover of £204,356 was not reasonable as: o Between 28 November 2019 and 17 June 2020, TIL received £60 from a relative of mine. o The sole owner of the Property was subject to bankruptcy proceedings commencing on 02 November 2018. On that date, legal and beneficial title to the Property passed to the Trustee in bankruptcy. The Trustee in bankruptcy has confirmed that they neither knew about, instructed, or approved any works to be conducted to the Property • I have stated I was aware of the bankruptcy of my relative when I was described as raising finance to seek an annulment of my relative’s bankruptcy • On 31 August 2022, TIL entered liquidation. The statement of affairs detailed creditors of £65,000 of which the BBL creditor was owed £50,000
