Conduct: Mr Philip Daniel Higgins (“Mr Higgins”) breached the terms of the Bounce Back Loan (“BBL”) Scheme by causing Focus Kickboxing Ltd (“FKL”) to overstate its turnover on its application for a BBL resulting in the company receiving a BBL of £45,000 when he knew, or ought to have known, that FKL was not eligible for a loan of that level, in that: The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.?? Companies established after 01 January 2019 were allowed to estimate their turnover for 2019 from the date trade commenced. FKL was incorporated on 17 September 2019.? Mr Higgins declared on the company’s BBL application form an estimated annual turnover of £180,000 for 2019, and consequently on 01 October 2020 FKL received a £45,000 BBL. Bank statements show receipts totalling £43,873.46 between 17 September 2019 and 31 March 2020. This is the first 197 days of trade. Based on the bank receipts, an estimate of annual turnover for 2019 would be £81,512. This would have meant the company was eligible to apply for a BBL of up to £20,378. The overstatement of turnover meant that FKL received £24,622 more than it was entitled to from the BBL scheme. At liquidation, FKL had liabilities totalling £56,523, of which £45,405.02* was owed to the bank in respect of the BBL.?
