Conduct: Bahroz Hussein Hamza (hereinafter referred to as “Mr Hamza”) caused Autospa (Slough) Limited (hereinafter referred to as “Autospa”) to obtain a Bounce Back Loan (hereinafter referred to as “BBL”) in excess of the amount it was eligible to borrow in that: • In order to be eligible for a BBL a business must have been carrying on its business on 01 March 2020 and engaged in trading of commercial activity. • A business that was eligible for a BBL could apply for a loan of 25% of their turnover for the 2019 year, up to a maximum of £50,000. If a company was incorporated after January 2019, estimated turnover could be used for the application. • Mr Hamza made an application with a British Bank on 14 June 2020 for a BBL of £50,000 and declared Autospa had an annual turnover of £220,000. • Autospa was incorporated on 13 September 2019. In the 9 month period from 13 September 2019 to 14 June 2020, the date Mr Hamza submitted the BBL application, credits totalling £39,398.99 were paid into Autospa’s bank account (excluding £10,756.04 received from HMRC under the Coronavirus Job Retention Scheme). This equates to an annual turnover of £52,531.98. • This would have entitled Autospa to a maximum BBL of £13,133. • Professionally prepared abridged financial statements show Autospa’s turnover for the period 13 September 2019 to 30 September 2020 was £71,251 (excluding £10,756 received from HMRC under the Coronavirus Job Retention Scheme). • This would have entitled Autospa to a maximum BBL of £17,813. • It is unclear on what basis Mr Hamza disclosed an annual turnover of £220,000. • On 21 October 2021, Autospa went into liquidation with liabilities totalling £50,120.43 of which £50,000 related to the BBL. Between 1 October 2020 and 21 October 2021, Bahroz Hussein Hamza failed to ensure that Autospa (Slough) Limited “Autospa” kept and maintained adequate accounting records; or in the alternative failed to preserve and deliver up such records as were maintained. As a result, it has not been possible to: • Establish why 13 transfers ranging in amount £500 to £2,500 were made from the company bank account between 1 October 2020 and 21 October 2021 totalling £28,200. • Establish why 15 cash withdrawals ranging from £90 to £8,400 were made from the company bank account between 1 October 2020 and 21 October 2021 totalling £38,875.68 and what the funds were used for. • Establish if the Bounce Back Loan obtained by Autospa has been spent on legitimate business costs. • Establish whether all of the £18,490.57 paid to the company between 1 October 2020 and 21 October 2021 under the Coronavirus Job Retention Scheme (hereinafter referred to as “CRJS”) were used for the purpose intended.
