Conduct: 9. Mr Krutkevicius caused Pav Viafort Ltd ("Viafort") to apply for a Bounce Back Loan ("BBL") of £50,000 on 25 January 2021, when it was not entitled to funds from the BBL scheme. Mr Krutkevicius then caused Viafort to pay £17,950 (net) of the £50,000 BBL funds received to a connected company, T J Krutkevicius Transport Limited (In Creditors Voluntary Liquidation) ("T JK") contrary to the terms of the BBL scheme. In that: 9.1. Under the terms of the BBL scheme, a business could apply for a BBL if it was engaged in trading or commercial activity at the date of the application and it was carrying on business on 01 March 2020. 9.2. Under the terms of the BBL scheme eligible businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. Where a business was established after 01 January 2019, the 25% limit was to be applied to the estimated annual turnover from the date business started . The purpose of the BBL scheme was to provide economic benefit to businesses. 9.3. Viafort was incorporated on 06 September 2019. 9.4. Mr Krutkevicius has stated that Viafort commenced trading in September 2019 9.5. Mr Krutkevicius has produced no evidence that Viafort was carrying on business as at 01 March 2020. 9.6. The turnover in Viafort's accounts for the period ended 30 September 2020 was £5, 115 and for the year ended 30 September 2021 was £551 9.7. Bank records show that Viafort's bank account was opened on 11 December 2020 with a £550 transfer from a connected company, T JK and, other than the receipt of BBL funds, Viafort had no receipts prior to 24 May 2021 . 9.8. On 25 January 2021 Mr Krutkevicius applied for a BBL of £50,000 on behalf of Viafort declaring that its turnover was £205,000. 9.9. Therefore Viafort was not entitled to funds from the BBL scheme because: - 9.9.1. Viafort was not carrying on business on 01 March 2020; or 9.9.2. If Viafort commenced trading in September 2019 its turnover in its first year of trading was £5,551; or 9.9.3. If Viafort had commenced trading prior to 01 March 2020 Mr Krutkevicius estimate of Viafort's turnover of £205,000 was unreasonable and without foundation given that Viafort's total turnover for the period from 06 September 2019 to 30 September 2021 was £5,666 9.10. On 29 January 2021 the £50,000 BBL was paid into Viafort's bank account. 9.11. On 15 March 2021 £22,500 was transferred from Viafort's bank account to T JK. 9.12. On 13 May 2021 £4,100 was transferred from Viafort's bank account to T JK. 9.13. Between 18 December 2021 and 24 March 2023 £8,650 of the transfers to T JK were repaid, leaving £17,950 outstanding. 9.14. On 12 April 2023 Viafort entered Creditors Voluntary Liquidation with total liabilities of £50,204 of which £50,203 relates to the outstanding BBL.
