Conduct: Miriam Nnenna Oji (“Mrs Oji”) caused Miles Professional Health Services Limited (“Miles”) to obtain a Bounce Back Loan (“BBL”) of £50,000 to which it was not entitled, as it was not trading on 01 March 2020, nor at the time of the application on 25 May 2020, contrary to the terms and conditions of the BBL scheme. In addition, Mrs Oji caused Miles to expend the £50,000 BBL funds for purposes that did not provide economic benefit to Miles, in breach of the BBL terms and conditions. In that: • The BBL Scheme terms and conditions state that applicants applying for a BBL on behalf of the business are required to declare that the business was engaged in trading or commercial activity at the date of the BBL application; had been carrying on business on 01 March 2020 and had been adversely affected by the coronavirus pandemic. • Miles was incorporated on 05 August 2019. • On 27 May 2020, Miles obtained a BBL of £50,000. Mrs Oji declared that Miles’ estimated turnover was £205,150. • Miles filed dormant accounts for the period ended 31 August 2020 at Companies House. • Miles’ bank statements show no trading activity prior to receipt of the BBL funds. • There is no evidence that Miles was carrying on business on 01 March 2020 nor that it was engaged in business or commercial activity at the date the BBL was received on 27 May 2020. Miles therefore obtained a BBL of £50,000 when it was not entitled to a BBL of any amount. • From 19 October 2020 to 23 October 2020, funds totalling £50,000 were transferred to third parties. No evidence has been provided to show that these transfers were for the economic benefit of Miles and as such were made in breach of the terms and conditions of the BBL scheme. • Miles was placed into Creditors Voluntary Liquidation on 20 September 2023. • Total liabilities at liquidation amount to £54,088 of which £50,603 relates to the amount owed in respect of the BBL (including interest).
