Conduct: On 26 June 2020, Esra Baser caused ATA Laundry Ltd (“ATA”) to breach the terms of the Bounce Back Loan (“BBL”) scheme by applying for a BBL to which it was not entitled. Furthermore, ATA failed to use the BBL for the economic benefit of ATA in that: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 1 January 2019 it is their estimated turnover. ATA was incorporated on 31 July 2019. On 26 June 2020, Esra Baser applied for a BBL of £21,250 on behalf of ATA declaring that its turnover for the calendar year 2019, or estimated annual turnover was £85,000. The BBL agreement was signed by Esra Baser on 26 June 2020. On 8 July 2020 ATA received the BBL funds of £21,250 into its bank account. Accounts for ATA record that it had been dormant prior to the period ending 31 July 2020. The accounts were signed by Esra Baser on 30 April 2021. The first transaction on ATA’s bank account was the receipt of the BBL funds on 6 July 2020. Following receipt of the BBL monies on 6 July 2020, other than 1 cash credit of £1,160 on 28 September 2020 and 2 payments totalling £80 in November and December 2020, no other funds were paid into ATA’s bank account. On 10 August 2020, £10,000 was withdrawn from ATA’s bank account. This did not provide economic benefit to ATA. On 28 September 2020 a payment of £7,000 was made from the ATA’s bank account to an unknown 3rd party. This did not provide economic benefit to ATA. ATA entered into Creditors Voluntary liquidation on 23 December 2022. Total liabilities at liquidation amounted to £23,050 of which £22,500 related to amount owed in respect of the BBL.
