Conduct: On 10 March 2021, Nassir Mahmood (“Mr Mahmood”) caused Pakistani Hot Food Takeaway Ltd (“PHFT”) to expend Bounce Back Loan funds of at least £25,569 out of £50,000 received, for purposes that did not provide economic benefit to PHFT, in breach of the BBL terms and conditions.   • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. Mr Mahmood applied for a BBL for an amount of £50,000 which was £11,970 more than it was entitled to.   • Under the terms and conditions of the scheme, funds provided in a BBL were to be used for the economic benefit of the business and were to be used wholly for business and not personal purposes. • Mr Mahmood applied for a BBL of £50,000, declaring in the BBL application that the funds would be used for the economic benefit of the business, and would be used wholly for business purposes and not personal purposes. • On 5 February 2021, the BBL funds of £50,000 were received, taking the balance on the bank account of PHFT to £52,168. Between 06 February 2021 and 10 March 2021 receipts into the bank account of PHFT totalled £15,563 and debits totalled £24,472. On 10 March 2021, a transfer of £43,300 was made to ‘N Mahmood CAR INSURANCE’, of which at least £25,569 can only have come from the BBL funds received in breach of the terms and conditions of the BBL scheme. • Mr Mahmood has failed to provide evidence that £25,569 of the £43,300 of BBL funds transferred to ‘N mahmood’ (sic) were used for the economic benefit of PHFT. • Total liabilities at liquidation amount to £99,801 of which £47,822 relates to the amount owed in respect of the BBL.
