Conduct: I failed to ensure that MSZ Services (WM) Ltd (“MSZ”) fulfilled its tax obligations as regards to Pay as You Earn (“PAYE”), Value Added Tax (“VAT”) and Corporation Tax (“CT”) and allowed MSZ to continue trade when MSZ became unable to meets its financial commitments to Her Majesty’s Revenue and Customs (HMRC) as and where they fell due from at least 6th of April 2020. In that: • From 06 April 2020 to liquidation on 18 July 2023, MSZ incurred a PAYE liability which HMRC assess as totalling £13,323,069.53 including interest and penalties. • Payments to HMRC in respect of PAYE total £552,942.20 from June 2020 to 30 April 2021. • For the period 31 May 2020 to liquidation, MSZ incurred a VAT liability which HMRC assess as totalling of £3,430,127.60 including charges and penalties of £45,761.96. • No payments in respect of VAT were made to HMRC. • For the years 2020 to 2022, the company incurred a CT liability of £97,042.09, consisting of debts of £38,396.91 for the year 2019/2020, £6,659.69 for the year 2020/2021 and £44,942.98 for the year 2021/2022 with interest of £7,042.51. • No payments were made in respect of CT. • HMRC made assessments and issued interest and penalties in respect of the PAYE, VAT and CT liabilities as I failed to co-operate with their enquires. • From 09 April 2020 to 08 February 2022, £10,446,283.56 was paid out of MSZ’s bank account, of which £5,154,611 was paid to me and £2,248,710.94 was paid to two other individuals whilst payments to HMRC totalled £552,942.20. • Outstanding liabilities at the date of liquidation are at least £15,784,827.40 all of which is owed to HMRC in respect of PAYE, VAT and CT.
