Conduct: On 20 May 2020 Brenda Omoruyi (“Ms Omoruyi”) caused Agape Home Limited (“Agape”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overestimating its turnover on a BBL application resulting in Agape receiving more funds that it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019 it is their estimated annual turnover from the date that the business was started. • Agape was incorporated on 20 June 2019 and commenced trading from this date. • On 20 May 2020 Ms Omoruyi applied for a BBL of £50,000 on behalf of Agape declaring its estimated turnover was £250,000. • On 21 May 2020 Agape received the BBL funds of £50,000 into its bank account. At this date the balance on the account was £275. • Agape’s bank statements show that between 23 November 2019 and the date of the BBL application, Agape received £17,580 into its bank account of which £17,225 appears to be trading income. • Agape entered Creditors Voluntary Liquidation on 16 May 2023. Total liabilities at liquidation amounted to £53,337, of which £44,657 related to the amount owed in respect of the BBL.
