Conduct: On 19 June 2020 Julie Elizabeth Cliff (“Mrs Cliff”) caused Pendle Housing Limited (“Pendle”) to make an application for and obtained a Government Back Bounce Back Loan (“BBL”) of £50,000 when she knew or ought to have known Pendle was not eligible to a BBL, In that: • The Bounce Back Loan (“BBL”) scheme allowed businesses to apply for a BBL if they were carrying on business on 01 March 2020, engaged in trading or commercial activity in the UK at the date of the application and had been adversely affected by coronavirus (COVID-19). A business could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover in calendar year 2019. The information provided was self-certified by the applicant. • The company was incorporated on 18 June 2019. • Mrs Cliff applied for a BBL of £50,000 on 28 May 2020, declaring a turnover of £400,000 and that Pendle was carrying on its business on 01 March 2020 and engaged in trading or commercial activity in the UK at the date of the application. • On 19 June 2020, a BBL of £50,000 was paid into Pendle’s bank account. • Dormant accounts were filed for Pendle for years ending 30 June 2020, 30 June 2021,30 June 2022 and 30 June 2023. • Pendle’s bank account shows from the date the bank account was opened on 18 June 2019, the first entry was the receipt of the BBL. The payment of the BBL funds on the 19 June 2020, was the first transaction paid into the company’s bank account. • At the date of the BBL, Pendle had not obtained the required planning permission or OFSTED approvals to begin trading. • As such, Pendle was not eligible for a BBL of any amount given it had no turnover, was not carrying on business on 1 March 2020 or engaged in in trading or commercial activity at the time of the BBL application. • On 12 July 2024, Pendle entered Creditors Voluntary Liquidation with known liabilities of £44,564.46, of which £43,563.46 is owed in respect of the BBL.
